Legal Counsel (Commercial Law and Foreign Market) - Cape Town

Requirements:

  • LLB Degree or equivalent; Admission as an attorney/advocate.
  • Ideally of 8 - 10 years of legal experience, preferably with experience in international trade, agriculture, or FMCG industries.
  • Experience with intellectual property, licensing and trade in foreign market regulations.
  • Experience in South African corporate and regulatory compliance.

Responsibilities, but not limited to:

  • Draft, review, and negotiate licenses for nurseries, commercial growers, and trial growers.
  • Negotiate and finalise commercial contracts with global suppliers and customers.
  • Assess supplier and customer contracts, ensuring alignment with business objectives.
  • Provide guidance on key contractual obligations and risk management strategies.
  • Research and interpret relevant laws in new operating regions.
  • Develop and roll out grower licences in new jurisdictions.
  • Manage execution of licences and contracts to facilitate supply chain operations.
  • Advise on legal considerations for establishing and maintaining fresh produce supply chains.
  • Identify and interpret laws regulating fresh produce supply in South Africa, North Africa, and Europe.
  • Ensure adherence to legal and regulatory requirements across multiple regions.
  • Provide proactive legal guidance to mitigate compliance risks.
  • Support global litigation cases by reviewing pleadings, preparing discovery, and conducting legal research.
  • Assist with day-to-day legal challenges in North Africa and Europe, such as customs clearance issues.
  • Advise on corporate law matters and corporate structures in South Africa.
  • Liaise with external legal counsel as needed.
